What I do NOT offer
- No bookings of any kind (hotels, flights, car rentals, activities, etc.)
- No fiduciary functions or payment processing
- No tour guiding on-site or during travel
- No brokerage of travel services for commission
- No package tours within the meaning of the German Civil Code (BGB)
No booking function
I do not make any bookings and do not act as an intermediary between you and travel providers. All bookings must be made by you directly with the respective providers (hotels, airlines, activity providers, etc.).
I do not receive payments for travel services and do not process any bookings.
1. Delimitation from tour operators (§§ 651a ff. BGB)
Tour operators according to § 651a para. 1 BGB are entrepreneurs who offer or sell package tours. A package tour exists when at least two different types of travel services (e.g. transportation + accommodation) are offered at a total price.
My delimitation: I do not offer package tours, but exclusively planning and consulting services. I do not combine travel services into packages and do not sell travel.
2. Delimitation from travel agents (§ 651b BGB)
Travel agents are entrepreneurs who offer the brokerage of package tours or individual travel services for remuneration.
My delimitation: I do not broker travel services and do not receive commissions from travel providers. My compensation comes exclusively from consulting services provided to the customer.
3. Delimitation from tour guides
Tour guides accompany and lead travel groups during the trip and are active on-site.
My delimitation: I do not accompany trips and am not active on-site. My service is limited to the planning phase before departure.
4. EU Package Travel Directive (EU Directive 2015/2302)
The EU Package Travel Directive, implemented into German law through §§ 651a ff. BGB, regulates rights and obligations for package tours.
My position: Since I do not offer or broker package tours, my activity does not fall under this directive.
5. Travel security certificate and insolvency insurance (§ 651r BGB)
Obligation: Tour operators must provide a security certificate and are required to have insolvency insurance.
My position: As a pure consultant, I am not required to provide a security certificate since I do not accept customer funds for travel services.
6. Commercial law provisions (GewO)
According to the German Trade Regulation, certain travel-related activities require notification or licensing.
My activity: Pure consulting services fall under general freedom of trade and do not require special permits in travel law.
Consequences for customers
- No entitlement to a package travel voucher
- No benefits from the travel security fund
- No warranty claims for travel defects
- No liability for the provision of planned travel services
Your rights and obligations
- The independent booking of all travel services
- The verification of availability and prices
- The conclusion of your own travel insurance
- The compliance with visa and entry requirements
- The execution of the trip at your own responsibility
